I am Ivor Jones, **The Māori Green Lantern**—a kaitiaki of truth, a writer standing with whānau against the machinery that calls poverty “compliance” and suffering “an administrative issue.” 

**I follow the whakapapa of policy: who designed it, who benefits, who carries the harm, and who is expected to stay silent when the Crown fails.**

This essay sets out the verified record of the Government’s mandatory welfare-check regime:

> the processing system that suspended or delayed payments even for people who complied; 

> the early warning that sat inside MSD for most of winter; 

> the limits of repayment; and

**Louise Upston should resign or be removed from this portfolio.**

That is an opinion rooted in the evidence below. It is not an allegation that she personally drafted the defective wording, personally operated MSD systems, or knew about every failure from the beginning. 

It is a judgment about ministerial responsibility: 

**the responsibility to ensure that laws match their stated purpose, systems are ready before coercive rules are imposed, warnings reach decision-makers, and harm is remedied rather than merely counted.**

## **The Law Was Wrong Before The Computers Switched Off Anything**

The Government introduced mandatory annual reviews to confirm whether people were receiving their correct entitlement. MSD says approximately 330,000 clients a year are expected to go through the process. **The Crown presented this as tidy administration: confirm your circumstances, keep the system accurate, move on. But a welfare rule is never just a form. It is state power pressing down on people who may already be navigating poverty, illness, disability, care work, unstable housing, patchy internet access, grief, violence, age, or the ordinary overload of trying to survive.**

**The policy intention was that affected NZ Superannuation and Veteran’s Pension clients would retain their Winter Energy Payment regardless of whether they completed the new process in time. **Urgency Removes Safety Rails.** The law passed under urgency, a procedure that reduces the time available for public submissions, select-committee examination and line-by-line scrutiny.

## **The Numbers The Minister Cannot Talk Away**

MSD’s completed review identifies **16,270** NZ Superannuation and Veteran’s Pension clients whose Winter Energy Payments were affected. The number initially reported publicly was 14,862; subsequent analysis increased it by **1,408** people, calculated as 16,270−14,862=1,40816,270 - 14,862 = 1,40816,270−14,862=1,408\. It is the phone call to a whānau member who has no more to lend. It is the rent shortfall. It is the medication put off. ### Example One: The Power Company That Cuts Off Customers It Promised To Protect

Imagine a power company announces a winter hardship programme. It tells pensioners and veterans they will remain protected. It then writes its own terms and conditions incorrectly, lets the automatic system cut the support anyway, and discovers months later that more than 16,000 people were affected. No sensible person would say: “Well, the computer technically followed the terms.” They would say the company failed before the computer acted. The board would face consequences. The chief executive would be asked how the basic safeguard was missed.

That is the ministerial equivalent here. Upston’s ministry is not an innocent bystander to a system from another planet. It is the department she is entrusted to lead politically.

**Quantified Harm:** The affected Winter Energy Payment group was 16,270 people, **1,408** more than first publicly identified. **Solution:** Put the protection directly and unambiguously in the law; independently test every welfare-payment rule against stated policy; prohibit automatic suspension of Winter Energy Payments while eligibility is being resolved; and publish the legislative amendment timetable before the next winter season.

**Tikanga Impact:** Manaakitanga means recognising people’s dignity and caring for their wellbeing. A state that turns a winter lifeline into an automated trap breaches that relationship. The harm is not only financial. It tells kaumātua and veterans that the Crown’s word is less reliable than its software.

### Example Two: The Bank That Punishes Customers For Answering Its Letter

Imagine a bank requires customers to reconfirm their details. You return every form, answer every question and provide all the information it asks for. The bank then fails to process your paperwork because it guessed wrongly how much work the exercise would create. It freezes your account anyway.

That is the administrative equivalent of what MSD’s review found. Its planning expected about one-third of respondents to report changes of circumstances. The actual result was around 80%. **Solution:** No payment suspension where a person has responded on time and their case remains in MSD’s queue. Staff the system for actual complexity, not Treasury-friendly fantasy. Preserve paper, phone, kanohi-ki-te-kanohi and community-provider routes as equal pathways—not degraded options for people left behind by digital-by-default design.

**Tikanga Impact:** Whanaungatanga means relationships of mutual obligation. The Crown demands compliance from the person at the bottom of the power relationship, yet fails to meet its own duty to process that compliance safely. That is not a relationship. It is extraction.

### Example Three: The Fire Alarm That Rang In April And Was Investigated In August

Imagine an aged-care facility receives a fire alarm two days after winter starts. Staff deal with individual smoke reports but nobody joins the dots. Senior leaders are not told of the broader danger for more than three months. Would anyone accept the excuse that each alarm had been treated as a separate incident?

MSD’s review says the first internal query about the Winter Energy Payment suspension issue was raised on **30 April 2026**, while senior leadership was not made aware of the broader issue until **13 August 2026**. **Solution:** Mandatory escalation thresholds must be written into operational policy: a small cluster of payment suspensions involving the same rule, payment type or system code must trigger senior review within days, not months. Ministers should receive regular risk reports during the rollout of any new regime with power to suspend essential income.

**Tikanga Impact:** Kaitiakitanga is active guardianship. It requires noticing danger, protecting people before harm expands, and accepting responsibility when protection fails. Treating each harmed person as an isolated file is the opposite of kaitiakitanga. It is institutional blindness with a case number attached.

## **The Government’s Spreadsheet Saw One-Third. Reality Was Eighty Percent.**

Children enter and leave care arrangements. People become sick. Relationships end. Housing costs rise. Work is irregular. Payments shift. Families absorb crises. Whānau make do.*

**The Government’s compliance machine treated all that reality as a surprise.**

## **The Warning Stayed Buried While Winter Did Its Work**

That is not reassurance. It is evidence of a system that sees people one at a time until the harm is too large to hide.

**Fragmentation Protects The Institution, Not The Whānau.* An isolated file is manageable. A pattern is a scandal. When every person is reduced to an individual service ticket, the system can postpone confronting the collective injury. Each person bears their own cold, late bill and humiliation while the institution waits for a dashboard strong enough to force attention.*

The known record does **not** establish that Louise Upston received the April warning when it arose. Her reported account is that she learned of the problem shortly before it became public, while officials said they briefed her the previous week. ***That limitation matters. I will not invent knowledge to intensify the argument. But ministerial responsibility is not eliminated by a broken briefing chain. A minister responsible for a new coercive welfare regime must ensure the regime has robust testing, quality assurance, escalation rules and reporting mechanisms before it is unleashed on the public. If a warning can sit for more than three months without reaching the level capable of acting on it, the ministerial oversight architecture has failed.***

The Crown can correct the number in its ledger. It cannot automatically correct:

- The interest charged because an account was overdrawn.
- The late fee on a power bill.
- The rent arrears notice.
- The food that was not bought.
- The medicine delayed.
- The shame of asking whānau for help.
- The stress carried into an already overloaded body.

Those outcomes are plausible, but they require direct testimony or case records before being reported as established facts in any individual case. The Green Party has called for compensation for affected families, recognising the difference between money restored and harm repaired. **The Crown’s Error Has A Ceiling; The Recipient’s Harm Does Not.* Government can characterise the remedy as arrears. The person receiving support may experience cascading consequences that are not included in the arrears calculation. The system’s legal limit becomes the whānau’s material loss.*

## **This Is Why Louise Upston Must Resign**

Louise Upston has called the errors “frustrating and unacceptable,” apologised, and said the Government will take steps to amend the legislation before the next winter payment schedule. The apology should be acknowledged. The remedial promise should be tested. Neither is enough.

A Minister for Social Development must meet a higher standard than “sorry it happened.” Her portfolio handles the state’s most direct power over people’s survival: the ability to decide whether a person has enough for rent, kai, heating, transport and basic dignity.

That is not one mistake. It is a ministerial portfolio failure with five separate doors, and every door opened onto the same people: those with the least ability to absorb delay.

My opinion is therefore direct: 

**Louise Upston should resign or be removed from the Social Development and Employment portfolio.** 

She has lost the public trust required to administer a system that can remove a person’s essential income.

## **The Wider Whakapapa Of Punishment**

This disaster did not emerge from nowhere. It sits inside a wider political pattern: the state builds more conditions around assistance, hardens sanctions, tightens eligibility and calls coercion “responsibility.”

In my earlier investigation, [**“The Traffic Light Taiaha”**](https://www.themaorigreenlantern.maori.nz/the-traffic-light-taiaha-how-a-white-supremacist-government-built-a-punishment-machine-that-creates-no-jobs-finds-no-work-and-feeds-only-on-brown-bodies-28-february-2026/), I examined the welfare-sanctions system administered under Upston’s portfolio. That essay cited published sanction data and argued that a punitive compliance model produces harm rather than stable work. The present MSD review adds a new and brutal fact: even when people comply, the system can still suspend their support because the Crown itself is not ready.

## **What Accountability Looks Like**

The Government must do more than apologise and amend a clause before the next winter. It must restore mana through action.

1. **Louise Upston Must Resign Or Be Removed From The Portfolio.** This is an opinion based on the verified institutional failures documented in this article.
2. **The Government Must Amend The Law Immediately.** The statutory protection for Winter Energy Payments must be explicit, not implied, and must prevent automatic suspension while eligibility questions are assessed. 4. **Consequential-Loss Redress Must Be Available.** People should not have to prove an abstract legal principle while carrying concrete costs caused by a state error. The Government should establish an accessible pathway for documented fees, interest and other direct losses caused by wrongful payment suspension.
5. **MSD Must Publish Lawful, Privacy-Protected Disaggregated Data.** The public needs to know who was affected by age, region, benefit type, ethnicity and disability status where those data are collected and can be released safely. Until then, no one should claim a numerical Māori impact as proved.
6. **No Future Suspension Regime Should Operate Without Human Safeguards.** People who respond on time should not have support suspended while MSD processes their information. Every affected person must have paper, phone, kanohi-ki-te-kanohi and trusted-community-provider routes equal to online processes.

## **The Moral Ledger**

Tikanga is not a decorative Māori word to paste onto a government press release. It is a standard of relationship and responsibility.

**Manaakitanga** requires care for the dignity and wellbeing of people. A regime that interrupts winter support because a protection is missing from a rushed law fails that test.

**Whanaungatanga** requires reciprocal obligation. The state demands people respond, disclose, attend and comply. When they do, the state must process their response competently. Suspending people anyway is a breach of that relationship.

**Kaitiakitanga** requires guardianship. The Crown knew—or should have designed systems capable of discovering—that automatic payment suspensions posed a systemic risk. Allowing the warning signs to sit from April to August was not guardianship.

This is **mauri-depleting** policy. It drains security from homes, imposes fear on people who need certainty, and tells those at the edges of survival that bureaucratic failure is simply another cost they must bear.

**A mauri-enhancing approach looks different. It begins with trust. It designs for complexity. It keeps human support available. It protects essential income while questions are resolved. It admits failure early. It compensates actual harm. And when a minister’s system repeatedly fails the people it exists to serve, it requires that minister to go.**

The taiaha is raised not against ordinary public servants trying to repair a broken process. It is raised against the political choice to build a punitive compliance regime without the care, capacity and accountability required to keep people safe.

**Louise Upston: your apology is noted. Your failure is documented. Your resignation is overdue.**
